2025 Employment Authorization Resources
We want to take a moment to share what we know about recent updates regarding the termination of the Temporary Protected Status (TPS) program and how it may impact employees with TPS designation.
What We Know:
- USCIS Announcement: The U.S. Citizenship and Immigration Services (USCIS) has announced the termination of TPS designation for Venezuela. The termination will take effect on April 07, 2025. After April 7, 2025, nationals of Venezuela (and aliens having no nationality who last habitually resided in Venezuela) who have been granted TPS under the 2023 Venezuela designation will no longer have TPS. This termination determination does not apply to the 2021 designation of Venezuela for TPS, which remains in effect until September 10, 2025, or to individuals who are registered for TPS under the 2021 designation.
Furthermore, On Jan. 10, 2025, Secretary of Homeland Security Alejandro N. Mayorkas announced the extension of Temporary Protected Status (TPS) for El Salvador for 18 months. This extension will be in effect from March 10, 2025, through Sept. 9, 2026. For additional information, please see the Federal Register notice.
- Employment Authorization Documents (EADs): TPS beneficiaries may continue to work lawfully using their EADs until they expire or the termination date, whichever comes first. USCIS has guidance regarding automatic extensions for certain TPS-related EADs, which you can find here.
- Next Steps for TPS Holders: Individuals impacted by this change should explore alternative immigration options and stay updated with guidance from USCIS or consult with an attorney. More information is available on the USCIS TPS Page.
What This Means for Employees:
- If you hold TPS and your EAD is expiring soon, please share your updated work authorization with HR as required by federal employment laws.
- We encourage anyone impacted to consult with an immigration attorney to understand their rights and options
